FAQs at Attestation of documents

1. I need to send a Power of Attorney duly attested by the High Commission of India, how can I make that ?

Executor / principal who wish to submit Power of Attorney (POA) needs to make the Power of Attorney with the help of concerned lawyer / legal expert keeping in view the purpose and requirement of the office where the POA required to be submitted finally.

2. Do I need stamp paper for preparation of POA in Canada?

The POA is not necessarily to be made on a stamp paper, however please check with the office where the POA is required to be submitted finally.

3. Can High Commission of India help in drafting POA?

No, there is no such facility in the High Commission of India for drafting POA. High Commission only attests the POA / Documents as submitted by the applicants, subject to usual checks.

4. How to get Power of Attorney Attested from the High Commission of India ?

5. Can I visit directly (walk-in) for Attestation of Power of Attorney / Document ?

You are required to take prior appointment for visiting High Commission of India for Attestation services.

8. How do I pay the fee for Attestation Services?

Fee can be paid by bank draft/money order in favor of “High Commission of India, Ottawa”. High Commission also accepts payment through Debit Cards at the counter at the time of submission of application for Attestation.

9. Can I submit my POA for attestation at the BLS office?

Attestation services are directly provided by the High Commission of India, thus no information with regard to Attestation is available with BLS. POA is only to be submitted at the High Commission of India with the documents as prescribed in the checklist.

10. Power of Attorney: Where can I submit my POA for attestation?

POA applications to be submitted at High Commission of India, 10 Springfield Rd, Ottawa, Ontario, Canada K1M 1C9

11. I am an OCI Card holder, can I submit the POA for attestation directly at the High Commission ?

All the foreign nationals (Canadian & other nationals) irrespective of their OCI status are required to attest the POA from their government authorities first then only it can be attested by the High Commission. All the Canadian nationals are required to get the POA first attested from Global Affairs Canada (Sussex Drive, Ottawa).

Other foreign applicants (than Canadian & Indian nationals) residing in Canada are required to first get the POA attested from their concerned Embassy / High Commission / Consulate in Canada, thereafter it can be attested by the High Commission of India.

12. Power of Attorney: I’m an Indian citizen, do I need to get pre-authentication from Service Ontario or provincial consular authorities?

Indian Nationals are not required to authenticate the power of attorney from Service Ontario or any provincial authority.

13. For Joint POA, do we need to fill up 2 application forms?

No, there is a separate application (two application) to be submitted for joint POA applications.

14. Power of Attorney: Do I need to get signature of 2 witnesses on the POA?

Yes, signatures of two witnesses known to the executor are required to be provided on the POA.

15. Do the witnesses need to visit High Commission personally?

Signature of witness is required on the POA. Presence of the witnesses in the High Commission for POA attestation is not required in those cases where the document has been signed first before a Notary. In other cases, two witnesses required to visit High Commission during attestation of POA.

16. What kind of documents can be attested by the High Commission ?

Several authorities in India as well as Canada ask for various documents duly attested by the High Commission of India. To fulfill the requirement of the applicants High Commission attests such documents which includes – Birth Certificate, Marriage Certificate, Education Certificates & Documents, Passport copies.

17. Can the documents be submitted directly to the High Commission for attestation ?

Please note the following conditions for Attestation of Documents :

(a) Documents issued by Canadian Government Authorities – All such documents viz., Birth Certificate, Marriage Certificate, Passport, etc., etc., issued by the Canadian Government authorities must be first attested by Global Affairs Canada (Sussex Drive) then only it can be attested by the High Commission.

(b) Documents issued by foreign countries (other than Canada and India) – All such documents need to be first attested by their concerned Embassy / High Commission / Consulate in Canada, thereafter it can be attested by the High Commission of India.

(c) Document issued by Indian authorities – All such documents (Educational Documents, Birth Certificate, Marriage Certificate, etc.) need to be first attested by Ministry of External Affairs, New Delhi thereafter it can be attested by the High Commission. Copies of Indian Passport can be attested directly by the High Commission.
